Privacy notice

EXPLOR SMA, domiciled at Salida Real a Querétaro 168, Zona Centro, 37774 San Miguel de Allende, Gto. and internet portal www.explorsma.com.mx, is responsible for the use and protection of your personal data, and in this regard we inform you of the following:

The person responsible for data protection is EXPLOR SMA, the person in charge in any case is Mr. SERGIO WILLIAMS BUSTOS of the Customer Service Department, who is located at the same address and who can be contacted by e-mail: agenciadeviajes@explorsma.com.

Data we collect

Personal data

The personal data collected are: first name, last name, telephone number, mailing address and e-mail address. If you choose to pay by credit card, the credit card number, expiration date, cardholder's name, and credit card statement address will be collected. When booking international flights we will collect the date of birth, passport number and the name and telephone number of a person specified by the customer who will not be traveling on those dates to serve as an emergency contact if necessary. When booking flights with a stopover or final destination in the United States, the nationality and gender of each passenger will be collected.

In the event that a reservation does not pass the risk verification protocol established by EXPLOR SMA, the following information will be requested from the reservation holder: copy of credit card on both sides and copy of an official photo ID on both sides.

For reconciliation of duplicate charges on the customer's credit card and refunds to personal accounts, a copy of the account statement will be requested.

This Privacy Notice, based on Article 10 section IV of the Federal Law for the Protection of Personal Data in Possession of Private Parties (LFPDPPP), is intended to fulfill the obligations arising from the legal relationship between the owner of the data and EXPLOR SMA.

The owner may express his refusal to the processing of his personal data for those purposes that are not necessary or that gave rise to the relationship between the client and EXPLOR SMA through the procedures of access, rectification, cancellation, opposition described in this Privacy Notice.

Non-personal information

Cookies are text files that are automatically downloaded and stored on the hard disk of the user's computer equipment when browsing a specific Internet page, which allow the Internet server to remember some information about the user, including his preferences for viewing pages on that server.

Web beacons are images inserted in an Internet page or email, which can be used to monitor the behavior of a visitor, such as storing information about the user's IP address, duration of interaction time on that page and the type of browser used, among others.

Please be informed that we use cookies and web beacons to obtain personal information from you, such as the following:

We collect and store non-personal information automatically each time you log on to EXPLOR SMA. This information is collected and used only to make ongoing improvements to the service provided to our customers.

How can I modify the way my browser handles cookies?

How your data is used

The data you provide will be used for the following purposes:

Process, complete, update, modify, cancel or print the services you have contracted through EXPLOR SMA by the following means: electronic, telephone, in person or in writing.
Sending notifications via email exclusively to inform about changes or events related to your travel itinerary: confirmation of contracted services, modifications, cancellations, refunds, balances and invitations to evaluate or give your opinion about the contracted services and the service received from EXPLOR SMA, its employees or representatives.
Telephone calls to request documents to establish the identity of the customer or credit card holder if EXPLOR SMA deems it necessary.
To receive travel offers by email if you agreed to subscribe to our newsletter electronically, by telephone, in person or in writing. In each email sent by EXPLOR SMA there is a link to unsubscribe from the newsletter if you wish to do so.
To maintain and constantly update databases that generate statistics that allow EXPLOR SMA to improve the services received by our customers.

Limits on use and disclosure of information

Sólo EXPLOR SMA tiene acceso a la información recabada (exclusivamente el correo electrónico del titular) cuando te suscribes a nuestro programa de promociones, ofertas o servicios a través de correo electrónico. En nuestros correos electrónicos pueden incluirse ofertas de terceras personas que sean socios comerciales, proveedores o empresas afiliadas de EXPLOR SMA. Los mensajes o avisos promocionales se envían única y exclusivamente a quien ha aceptado suscribirse, mensajes y avisos que puedes dar de baja de tu correo electrónico en cualquier momento dando clic en la liga que aparece para este fin en cada mensaje que enviamos.

How we protect your personal data

EXPLOR SMA has implemented a sophisticated security system to protect our clients' information from unauthorized access. Our systems are configured with data encryption and encoding technologies built with the best industry standards. All data transmissions from EXPLOR SMA sites are encrypted before being sent using SSL-3 technology.

How you can access your personal data

The Ley Federal de Protección de Datos Personales en Posesión de los Particulares establishes 4 actions that you have the right to exercise over the personal data you provide: (i) access to your personal data to know the details of their treatment,(ii) as well as to rectify them in case they are inaccurate, incorrect or outdated; (ii) cancellation when you consider that they are not required for any of the purposes indicated in this privacy notice, or are being used for non-consensual purposes or the contractual or service relationship has ended, or, (iv) opposition to the treatment of them for specific purposes (known as ARCO rights).

If you need access to the personal data you provided, please send to e-mail agenciadeviajes@explorsma.com to the attention of Sr. SERGIO WILLIAMS BUSTOS, a request with the following:

Full name and telephone number or address
Copy of an official identification with photo or that accredits you as the owner of the data to which you wish to access or, if applicable, as the legal representative of the owner.
Specify the treatment you want to be done with the personal data collected.
Locator number. With this information we can quickly find your data.

EXPLOR SMA will communicate to the holder by e-mail, within a maximum period of twenty days from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted, in order that, if appropriate, it becomes effective within fifteen days from the date on which the response is communicated. In the case of requests for access to personal data, the delivery shall be made upon proof of the identity of the applicant or legal representative, as appropriate.

The aforementioned terms may be extended only once for an equal period, provided that the circumstances of the case so justify.

Data transfers

The personal information you provide at the time of booking is shared with the suppliers or affiliated companies you contracted with to process and complete the services you purchased through EXPLOR SMA. We never transfer personal data to persons or companies outside EXPLOR SMA. The information that is transmitted to suppliers or affiliated companies with whom you have contracted depends on the service you booked:

Hotel, transfers, tours and bus tickets: your name and surname are transferred exclusively to the supplier.
Flights that do not have a stopover or final destination in the United States: only your first and last name is transferred to the airline.
For flights with a stopover or final destination in the United States, only your full name, date of birth and gender are transferred to the U.S. Government Transportation and Security Administration.
For car rental reservations, only your first name, last name and address are transferred.
Cruises: name, surname and passport number.
Travel arrangements: name, surname and passport copy.

The purpose of the transmission of the data listed above is necessary for the existence and fulfillment of the legal relationship between the customer and EXPLOR SMA.

The holder may express its refusal prior to the processing of personal data through the procedure described in this Privacy Notice, or the holder will have a period of five days to, if applicable, express its refusal for the processing of personal data for purposes other than those that are necessary and give rise to the legal relationship between EXPLOR SMA and the owner of the data. If the owner does not express his refusal for the processing of his data in accordance with the above, it will be understood that he has given his consent for the processing of the same, unless proven otherwise.

Data transfers

EXPLOR SMA reserves the right to modify or change this Privacy Notice if necessary. The changes become effective at the time they are published on any of its websites. These changes are published on the web address: Explor Sma.

By processing reservations with Liverpool, its representatives or affiliates electronically, by telephone, in person or in writing, the owner of the data accepts this Privacy Notice. If the user uses the services of EXPLOR SMA, it means that he/she has read, understood and accepted the above terms.
